Terms of Service

By accessing or using TrustyGenius, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

Access to TrustyGenius features requires an approved, provisioned workspace and any applicable active subscription or engagement. Commercial terms, billing timing, and included services are confirmed during setup or in the applicable order form.

You acknowledge that:

• The platform may contain bugs or errors
• Features may be added, modified, or removed at any time
• Service availability is not guaranteed
• Data may be lost, corrupted, or deleted without warning
• You should maintain backups of all important data

TrustyGenius is a software tool for research and analysis purposes only. You acknowledge and agree that:

• The platform does not provide personalized investment advice or recommendations
• AI-generated outputs, including strategy suggestions, backtests, and market analysis, may contain errors and should not be relied upon as the sole basis for trading decisions
• Users are solely responsible for their own investment and trading decisions
• Past performance of any strategy, backtest, or analytical output does not guarantee future results
• You should consult a qualified financial advisor before making investment decisions
• TrustyGenius is not a registered investment advisor, broker-dealer, or financial planner

The platform makes extensive use of artificial-intelligence models. You acknowledge that AI-generated content — including analysis, summaries, alerts, code, emails, and agent actions — can be incomplete, out of date, or simply wrong (including confident- sounding errors). Review features such as secondary agent checks and validation gates reduce, but do not eliminate, this risk. You are responsible for reviewing AI output before acting on it. TrustyGenius does not warrant the accuracy, completeness, or fitness of any AI-generated content.

The platform depends on third-party services, including AI model providers, market-data sources, e-mail delivery, payment processing (Stripe), and brokerage connectivity. You acknowledge that:

• Subscription fees cover the platform only. Third-party market data subscriptions, exchange fees, API access, brokerage commissions, and similar costs are not included — you procure and pay for your own data feeds and broker connectivity (bring your own data)
• You are responsible for complying with the license terms of any data you connect (including redistribution and display restrictions imposed by exchanges and data vendors)
• Market data may be delayed, incomplete, or inaccurate, and is provided for research purposes only
• Third-party services may change, fail, or become unavailable without notice, and TrustyGenius is not liable for their acts, omissions, outages, or data errors
• Your use of third-party services through the platform may be subject to those parties' own terms

TrustyGenius is a research and simulated ("paper") trading platform. It is not designed, offered, or intended for live trade execution, and you agree not to use it to place live trades or to rely on it for trade advice. Brokerage connectivity, where offered, is provided for market data and simulated tracking only. If you nevertheless configure any component to transmit live orders, you act outside the intended use of the platform and entirely at your own risk: you are solely responsible for all orders, positions, fees, and losses in any brokerage account, including those resulting from automated or agent-initiated activity you have enabled, software errors, or data errors.

You acknowledge and agree that data you store on the platform — including time series, research, conversations, strategies, portfolios, and settings — may be lost, corrupted, or become unavailable at any time. Durable storage and backups are provided only where your plan or engagement expressly includes them; plans without an express backup commitment carry no data-durability obligation of any kind. You are responsible for exporting and separately retaining any data you cannot afford to lose. Upon termination or cancellation, your data may be deleted after a reasonable period without further notice.

While we implement security measures, we cannot guarantee the security of data. Do not upload sensitive, confidential, or regulated data. You are responsible for compliance with all applicable data protection laws. See our Privacy Policy for details.

Subscription fees are billed monthly or annually in advance via our payment processor. You may cancel your subscription at any time, effective at the end of the current billing period.

• Pricing changes. We reserve the right to change subscription prices, introduce new fees, or modify plan features and limits at any time. Price changes take effect at the start of your next billing period following notice (by e-mail or in-app, at least 14 days in advance for existing subscribers). Your continued use of the platform after a price change takes effect constitutes acceptance of the new price; if you do not accept it, your sole remedy is to cancel before the change applies.
• Refunds. Except where required by law, all fees are non-refundable, including for partial billing periods, service interruptions, data loss, feature changes, or account termination for violation of these terms.
• Taxes. Fees are exclusive of applicable taxes, which are your responsibility.
• Third-party costs. Subscription fees do not include third-party costs such as market-data subscriptions, exchange or API fees, or brokerage commissions (see Section 6). Plans include stated usage allowances (such as AI tokens); usage beyond an allowance may be throttled or billed as overage.

The platform is provided without any uptime commitment or service level agreement. Maintenance, upgrades, or circumstances beyond our reasonable control (including failures of hosting, network, or third-party providers) may interrupt the service at any time without notice. Scheduled and autonomous agent activity may be delayed, skipped, or interrupted by such events.

You agree not to use the platform for any unlawful purpose or in violation of these terms. Prohibited uses include but are not limited to:

• Violating any applicable laws or regulations
• Infringing on intellectual property rights
• Transmitting malicious code or viruses
• Attempting to gain unauthorized access
• Harassing or harming other users
• Using the service for illegal activities
• Reverse engineering, copying, reselling, or sublicensing the platform or any part of it, except as expressly permitted in a written agreement

We may suspend or terminate your access at any time for violation of these terms, non-payment, suspected abuse or security risk, or discontinuation of the service. You may terminate at any time by cancelling your subscription. Sections concerning disclaimers, liability, indemnification, and data retention survive termination.

To the maximum extent permitted by law, TrustyGenius shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, including any trading losses or investment losses resulting from your use of the platform. In all cases, the aggregate liability of TrustyGenius arising out of or relating to the platform shall not exceed the amounts you paid to TrustyGenius in the twelve (12) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless TrustyGenius and its affiliates from any claims, damages, or expenses arising from your use of the platform, your trading or investment activity, or your violation of these terms.

We reserve the right to modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the new terms.
